Warranty Terms for Hardware

In addition to the statutory warranty rights, we offer our customers a warranty for our hardware under the following warranty conditions.
This warranty is a voluntary service from us. The statutory warranty rights apply independently of this warranty and are not restricted by it.

1. Scope of Warranty Service
1.1. The warranty applies to used, refurbished, and new hardware.
1.2. The warranty-triggering event is a defect in the hardware related to mechanical and electronic components. Installed and/or usable software on the hardware is excluded from the warranty services.
1.3. During the warranty period, we will, at our discretion, either replace the defective product at our expense or provide free repair. Repairs and/or replacement of defective parts under the warranty may be carried out using functionally equivalent replacement parts.
1.4. In the event of a warranty claim, we will cover all shipping costs if the customer is located within the European Union or provides a shipping address within the EU. Customers outside the EU must bear the full shipping and transportation costs. If customers require additional insurance beyond our legal obligations, they must cover these costs themselves.
1.5. Should repair or replacement not be possible or economically reasonable in the event of a warranty claim, we reserve the right to reimburse the current value or a proportion of the purchase price of the affected hardware.
2. Conditions for Claiming Warranty Services
2.1. The warranty applies exclusively to hardware purchased from us.
2.2. The warranty is intended for both consumers (as per Section 13 BGB) and businesses (as per Section 14 BGB). A consumer in this context is any natural person who enters into a legal transaction, such as purchasing and using the hardware, for purposes that are primarily neither commercial nor self-employed. A business is any entity that orders and uses the hardware as part of its self-employed, professional, or commercial activities.
2.3. The warranty must be claimed in writing (by letter) or in text form (e.g., by email) within 14 days of becoming aware of the warranty case. Late warranty claims are not possible. The merchant’s obligation to report defects under Sections 377 et seq. HGB remains unaffected.
2.4. To claim the warranty, both the warranty terms and the purchase receipt must be provided. If either of these documents is missing, we are entitled to refuse any warranty services.
2.5. The warranty claim shall expire if an unreasonably long period of time passes between the receipt and confirmation of the warranty claim by the guarantor and the subsequent request by the guarantor to return the goods concerned for further processing and examination of the warranty claim for which the guarantor is not responsible. In particular, the claim expires if the goods are not returned to the guarantor within 14 days despite a corresponding request.
2.6. Warranty claims shall be excluded if any changes, modifications, extensions, or repair attempts are carried out on the hardware or the software installed on it (including firmware) by third parties not authorized by Tonitrus.
2.7. The claim also lapses if the serial number or other identification marks of the hardware have been removed, altered, or rendered illegible.
3. Scope of Warranty Coverage
The warranty applies worldwide.
4. Warranty Duration
4.1. The warranty period is 3 years for used and/or repaired/refurbished as well as new hardware. The warranty period is 1 year for used and/or repaired/refurbished laptops as well as for new laptops and laptop accessories. Additionally, depending on the product and for an extra charge, a lifetime warranty may be available.
4.2. The warranty period starts from the invoice date. Claiming a warranty does not extend or renew the warranty period.
4.3. In the case of replacement of hardware during the warranty period, the warranty period does not start anew, but continues from the original invoice date.
5. Warranty Exclusions
Warranty claims are excluded in the following cases, provided they have contributed to the defect.
5.1. Improper storage or use. This includes storing or using the hardware in environments with humidity or temperature outside the original manufacturer's specifications. If the hardware indicates exposure to improper storage conditions, the customer must demonstrate compliance with the required conditions.
5.2. Failure to follow the instructions or guidelines provided in the user manual.
5.3. Normal wear and tear. This includes usage marks and wear on parts subject to mechanical or natural wear, such as mechanical components or batteries.
5.4. Damage caused by chemical, physical, or other external influences (e.g., impact damage, etc.).
5.5. Damage caused by weather conditions or natural events (e.g., floods, frost, etc.).
5.6. Damage caused by direct sunlight or heat exposure from radiators.
5.7. Finally, warranty services are excluded if service or repair work on the hardware has not been performed by us or an authorized service provider. Customers may suggest a service provider for maintenance work.
5.8. Damages caused by malware or computer viruses leading to hardware defects are excluded from the warranty.
6. Warranty notifications
6.1. Warranty notifications must be addressed to Tonitrus GmbH, Teerhof 59, 28199 Bremen, Germany.
